Welcome to Giving Trunk$. These Terms of Service (“Terms”) govern your use of the Giving Trunk$ website and app (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
Who can use Giving Trunk$
You must be at least 18 years old and the parent or legal guardian of any child whose profile you create. Parents and guardians are responsible for setting up and supervising their children’s use of the Service. Children do not create their own accounts.
What Giving Trunk$ is
Giving Trunk$ helps families create kids’ wish lists across three lanes — Buy It (gift ideas), Give It (charitable causes), and Save It(savings goals) — share them with friends and relatives, and learn about money through our Money School lessons and games. Giving Trunk$ is a planning, sharing, and educational tool. It is not a store, a bank, a broker, or a charity.
Your account
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Let us know promptly if you believe your account has been used without your permission. You agree to provide accurate information and to keep it up to date.
Gifts, purchases, and donations
Buy It.When you or a gift-giver chooses to purchase an item, that purchase takes place on a third-party retailer’s website and is governed by that retailer’s own terms and policies. Giving Trunk$ is not the seller and may earn a referral or affiliate commission when a purchase is made through the Service. We are not responsible for the products, pricing, availability, payment, shipping, returns, or customer service provided by retailers.
Give It. Charitable donations are processed by a third-party donation provider and go to the organizations you or your gift-givers select. Giving Trunk$ is not a charity and does not provide tax advice; any tax treatment of a donation is between the donor and the receiving organization. As disclosed in the Service, a small platform fee is never taken out of the amount that reaches the cause.
Save It.Save It is a goal-tracking tool that helps kids set and visualize savings goals. It is not a bank account, deposit account, or investment product, it is not FDIC-insured, and Giving Trunk$ does not hold, transfer, or manage your family’s money.
Money School is education, not financial advice
The Money School lessons, games, and calculators are provided for general educational purposes to help children learn money concepts. They are not financial, investment, tax, or legal advice, and should not be relied on as such.
Acceptable use
Please use the Service only for its intended, lawful purpose. You agree not to misuse the Service, interfere with its operation or security, attempt to access accounts or data that are not yours, upload harmful or unlawful content, or use the Service to harm others. We may suspend or limit access if the Service is being misused.
Content and ownership
You keep ownership of the content you add, such as wish-list items and messages. You grant Giving Trunk$ the limited permission needed to store and display that content in order to operate the Service for your family. Giving Trunk$ and its name, design, and educational content remain our property.
Beta service — provided “as is”
Giving Trunk$ is offered in an early stage and is provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law. We work hard to keep the Service reliable and secure, but we do not promise it will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Giving Trunk$ will not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including any issues with third-party retailers or donation providers. Nothing in these Terms limits rights that cannot be limited under applicable law.
Ending your use
You may stop using the Service and close your account at any time; closing your account removes your family and child information from our active systems as described in the Privacy Policy. We may suspend or end access if these Terms are violated or to protect the safety of families using the Service.
Changes to the Service or these Terms
We may update the Service and these Terms from time to time. If we make material changes to these Terms, we will update the date above and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which Giving Trunk$ is organized, without regard to conflict-of-laws principles. If any provision is found unenforceable, the remaining provisions stay in effect.
